Terms of Service

These Terms govern your use of Lily (Telegram bot + web portal at https://diary.sankalpagarwal.in), operated by Adv. Sankalp Agarwal.

By using the Service you agree to these Terms and our Privacy Notice. If you do not agree, do not use the Service.

1. Eligibility & accounts

  • The Service is intended for advocates and legal professionals registered with Lily.
  • You must provide accurate registration details (name, mobile, office, email where applicable).
  • Access is via your registered mobile number and Telegram OTP. You are responsible for securing your Telegram account and device.
  • One tenant account per advocate firm/person unless we expressly approve otherwise.
  • You must not share login sessions or allow unauthorised persons to access your docket.

2. Description of the Service

Lily provides a legal case diary including, without limitation:

  • Case storage, hearing dates, cause lists, and docket exports (PDF/CSV)
  • Court status lookups (High Court, district/commercial eCourts, DRT/DRAT) on your request
  • Telegram-based reminders and optional Google Calendar sync
  • Web portal for viewing and editing your docket (where enabled for your role)
  • Platform administration, billing, and support features for subscribed client advocates

The Service is a productivity tool. It does not provide legal advice, does not create an advocate–client relationship between you and Lily, and does not replace your professional judgment or court filings.

3. Your content & responsibilities

  • You retain ownership of case data you enter. You grant us a limited licence to host, process, back up, and display that data solely to operate the Service.
  • You are solely responsible for the accuracy of case numbers, party names, dates, and notes you save.
  • You must have a lawful basis to store personal data of parties/litigants in your docket and comply with applicable law (including the DPDP Act 2023 as a Data Fiduciary where applicable).
  • You must not use the Service for unlawful purposes, harassment, spam, or to upload malicious content.
  • Telegram text-only workflows apply on the bot; do not rely on the Service for storing original court orders unless you have separately saved them.

4. Subscription, fees & payment

  • Client advocates may be on a paid plan as communicated during onboarding or in billing reminders.
  • Fees, due dates, and payment methods (including UPI) are as notified by Lily admin.
  • Non-payment may result in suspension of access after reasonable notice.
  • Fees are exclusive of applicable taxes unless stated otherwise.

5. Acceptable use

You agree not to:

  • Reverse engineer, scrape, or overload the Service or court portals via automated abuse
  • Attempt to access another advocate’s docket or bypass authentication
  • Interfere with security features (OTP limits, session controls, tenant isolation)
  • Resell or white-label the Service without written permission

We may suspend or terminate access for violation of these Terms or for risk to the platform or other users.

6. Third-party services

The Service integrates with third parties including Telegram, Google Calendar (optional), and public court websites. Their terms and privacy policies apply to your use of those services. We are not responsible for third-party outages, captchas, or changes to court portals.

7. Availability & changes

  • We strive for reliable uptime but do not guarantee uninterrupted or error-free operation.
  • Scheduled maintenance, court portal changes, or force majeure may affect features.
  • We may add, modify, or discontinue features with reasonable notice where practicable.
  • Material changes to these Terms will be posted at https://diary.sankalpagarwal.in/terms and/or notified via Telegram. Continued use after the effective date constitutes acceptance.

8. Intellectual property

Lily’s name, branding, software, documentation, and UI are owned by us or our licensors. You receive a limited, non-exclusive, non-transferable licence to use the Service during your subscription. You may not copy or redistribute the application except as outputs you generate (e.g. your own docket PDFs).

9. Confidentiality

We treat your docket as confidential within our platform controls. We do not publish your cases to other tenants. Support access by platform admin is limited to operational needs (billing, troubleshooting, compliance).

10. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT COURT STATUS, CAUSE LISTS, OR HEARING DATES FROM PORTALS ARE ACCURATE, COMPLETE, OR CURRENT — ALWAYS VERIFY WITH OFFICIAL COURT RECORDS.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR MISSED HEARINGS, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE FEES PAID BY YOU TO LILY IN THE THREE (3) MONTHS PRECEDING THE CLAIM (OR INR 5,000 IF NO FEES WERE PAID), WHICHEVER IS GREATER.

12. Indemnity

You agree to indemnify and hold us harmless from claims arising from your misuse of the Service, your docket content, violation of law, or breach of these Terms.

13. Termination

  • You may stop using the Service at any time and may request account erasure under our Privacy Notice (/deletedata on Telegram or the Privacy tab on the web).
  • We may suspend or terminate your account for breach, non-payment, or legal requirement.
  • Sections that by nature should survive (liability limits, indemnity, governing law) survive termination.

14. Governing law & jurisdiction

These Terms are governed by the laws of India. Subject to applicable consumer protection law, the courts at Lucknow, Uttar Pradesh, India shall have exclusive jurisdiction over any dispute arising from or relating to these Terms or the Service. You agree to submit to the personal jurisdiction of such courts.
